TERMS AND CONDITIONS

PLEASE REFER TO THE FOLLOWING TERMS AND CONDITIONS IN THE BEST INTEREST OF SUCCESSFUL & SMOOTH PROJECT EXECUTION, THAT ARE DERIVED FROM OUR YEARS OF EXPERIENCE WORKING WITH VARIOUS TYPES OF CLIENTS AND PROJECT REQUIREMENTS.

COMMUNICATION

  • KAM’s office timings are 10.00a.m - 6.30pm from Monday to Saturday.
  • KAM’s executives are available on calls only during office hours.
  • CLIENT is requested to contact a concerned KAM’s executive for followup/ queries about drawings on our land-line numbers: 8552007020, 8552007040 and 807702007
  • The contractors (POP contractor, carpenter, painter, electrician, plumber etc.) are requested to call us on our land-line numbers for any queries.
  • CLIENT is requested not to provide KAM’s cell numbers to the contractors.
  • KAM’s encourages CLIENT to use Whatsapp messaging as a preferred mode of communication in order to maintain all the records and for smooth execution. There are instances where phone calls may remain unattended due to ongoing meetings, and during on-site visits and material selection for other clients.
  • CLIENT is requested to use Whatsapp group chat to communicate any changes or requirements. Do not post any changes or requirements to any individual persons Whatsapp chat. KAM’s is not responsible if any such requirements or changes are missed out.

ON SITE VISIT & MEETINGS

  • CLIENT is requested to book the on-site visit at least 2 days prior to the proposed visit date.
  • The specific number of site visits are assigned to each project as per the agreement. Thereafter, any additional visits would be charged at INR 3000/- per visit within Pune and PCMC city area. Outstation projects are charged on the basis of the site location.
  • Site visits are scheduled only after 3.30pm.
  • The prior appointment is not necessary for the meeting at KAM’s office during first half of the day. (10.30am to 1.30pm).
  • CLIENT is requested to visit KAM’s studio for any changes in drawing or communicate through Whatsapp or Team Viewer. KAM’s do not provide on-site service for this purpose.

PAYMENT AND FEES

  • GST 18% extra applicable in addition to fees.
  • Advance payment is non-refundable.
  • CLIENT is requested to release payments according to respective project phases within 15 days from the date when the performa invoice is generated. Please note that the project folder gets blocked on the system automatically after the due period is over.
  • In case of pending dues, services are resumed only after clearing the dues.
  • The client agrees to pay the professional charges commensurate with the stages of the work in case of project termination.

DESIGN, MATERIAL SELECTION, AND PROJECT TIME-LINE

  • KAM’s requests CLIENT to provide enough time when CLIENT expects multiple design options.
  • CLIENT is requested to visit various showrooms and shops (from our preferred vendors or vendors of CLIENT’s choice) to finalize vendor for material selection.
  • Assigned KAM’s executive accompanies CLIENT only to finalize the selected material. Selection of any material in showrooms is done mostly in one visit and rarely in maximum of two visits.
  • Project completion time depends on revisions/changes in design-concept and also depends upon adherence of timely payments. Mostly, the delays cause due to changes in designs-concept, selection of materials, and delayed payments to KAM’s, vendors or contractors.
  • Any revisions, requested after the detailed drawing is prepared are chargeable. These revisions will be done only when the designer is available from their ongoing projects for other clients.

RESPONSIBILITIES

  • KAM’s services are limited to consultancy, designing and selection of materials only.
  • CLIENT reserves full rights to choose the team of vendors and contractors of his/her own choice or from KAM’s preferred list of vendors and contractors, according to the budget or any other applicable criteria.
  • KAM’s does not guarantee and is not responsible for the quality of materials, quality of work, pricing and timeliness of any vendors and contractors.
  • KAM’s responsible for explaining drawings to the contractors from KAM’s preferred list.
  • CLIENT reserves full rights for negotiating rates and for obtaining any discount from vendors and contractors.
  • CLIENT is solely responsible for timely payments to the vendors and contractors to avoid any delays.
  • CLIENT makes payments directly to the respective vendors and contractors. KAM’s does not accept any payment on behalf of vendor/ contractor to maintain utmost transparency in all financial dealings.
  • KAM’s is not responsible for any financial dealings between CLIENT and contractors/vendor.
  • CLIENT is solely responsible for getting the work done from the builder(flooring, toilet dado, kitchen otta and dado, electrical wiring, POP and painting) and it’s accuracy as per the drawings. KAM’s is not responsible for wrong execution, finishing and any delays by the builder.

TERMINATION OF ENGAGEMENT

  • The engagement as per this agreement may be terminated by either CLIENT or KAM’s at any time with the written notice. In case of such termination, KAM’s shall be paid with the design fees commensurate with the stages of the work at the time of the said termination.
  • KAM’s reserves full rights to terminate the project at any stage in case of delays in making the payment and also due to any other discrepancies observed against the agreed terms and conditions that holds KAM’s back from continuing work on the project.

COPYRIGHT

  • All the design, drawings, and work executed according to on KAM’s designs shall remain the property of KAM’s Designer Zone.

LIABILITY OF KAM’s DESIGNER ZONE

  • KAM’s has no liability for any part of the work which the liability rests with vendor or contractor or arising from any act by them not being accordance to the KAM’s design and drawings.
  • Every working/detailed drawing shall be studied and understood by the CLIENT and contractor and clarifications shall be sought from KAM’s executive prior to the execution of the work. KAM’s shall not be liable for any modifications that client may wish to carry out after the execution of the said work or for mistakes arising due to improper understanding of the design and drawings.
  • The CLIENT/contractor shall bring to KAM’s notice, any discrepancies found in the drawings prior to execution of the work.
